            Refusal Notice 

Thank you for your request for information which we received on 28th July 2015. 

Under the terms of The Freedom of Information Act 2000 I am declining to supply you with the information you requested under: 

Section 22

Determined as:          At the time a public authority receives a request for information: 

  • The public authority or another person intends to publish the information at some future date. 

NHS England has informed us that they anticipate that the requested information (in aggregated report form) will be published on their website later this year.  NHS England will not publish the template forms in their entirety but the majority of information will be represented in the summary reports which they intend to publish. 

Section 43

Determined as:          Release of the information is likely to prejudice the commercial interest of any person.  (A person may be an individual, a company, the public authority itself or any other legal entity.) 

The information included in our plans, which is submitted in confidence to NHS England, includes detailed finance and activity data.  As such we consider the remaining information not planned for future publication by NHS England, to be exempt under section 43. 

If this data were available to other provider organisations it could potentially affect our Providers’ commercial interests.  In releasing the information to you as a requester under the Freedom of Information Act 2000, we would be agreeing its release into the public domain and by doing so make it available to local provider organisations.  We therefore consider this information to be exempt under Section 43 of the Freedom of Information Act 2000 as information which, if released, would be likely to prejudice the financial interests of the CCG in commissioning services effectively and efficiently. 

Section 43 is a qualified exemption which is subject to the public interest test.  We consider that the public interest is served by the publication of the Financial Plan on the NHS England website
